Terms and Conditions of Sale (TCS)

PREAMBLE

These Terms and Conditions govern all sales made on the website www.pastandpresent.com, between:

(hereinafter referred to as “the Seller”)

and

any natural or legal person making a purchase through the website

(hereinafter referred to as “the Customer”).

 

1. PURPOSE

These Terms and Conditions of Sale define the rights and obligations of the parties within the framework of the online sale of original movie posters, art prints, engravings, vintage objects, and collectible items offered by Past & Present.

2. PRODUCTS

The products available for sale include original cinema posters, art prints, engravings, collectible VHS tapes, and a curated selection of vintage decorative objects such as embroidery frames, samplers, toy cars, and other curiosities.

Each item is carefully described and accompanied by a detailed product sheet.

Please note that the visuals shown on the website are non-contractual — slight variations in tone, texture, or format may occur depending on the original medium or the digitization process.

3. PRICES

Prices are displayed in euros (€) and are inclusive of all taxes (TTC).

Shipping fees are calculated and specified during checkout.

Affiches d’Arts et de Cinéma reserves the right to modify its prices at any time. However, products will be billed at the rate in effect at the time of order confirmation.

 

4. ORDERS 

Placing an order on the website implies full and unconditional acceptance of these Terms and Conditions.

Once the order has been confirmed and payment successfully processed, the Customer will receive a confirmation email summarizing the details of their purchase.

The Seller reserves the right to cancel or refuse any order in the event of non-payment, prior disputes, or suspicion of fraud.

 

5. PAYMENT

Payment is made online, via credit card, PayPal, or any other secure payment method offered on the website.

The order is considered confirmed only after the payment has been validated.

6. DELIVER

Posters and items are carefully packed using appropriate packaging materials, then shipped via Colissimo, La Poste, a carrier, or an equivalent service within 7–14 business days (excluding weekends and public holidays).

In the event of any issue or delay, the Customer will be notified by email.

Deliveries are made to the address provided by the Customer at the time of the order.

In case of an error in the delivery information, Past & Present cannot be held responsible for any delay or failure in delivery.

7. RIGHT OF WITHDRAWAL & RETURNS

In accordance with European regulations, the Customer has a 14-day period from the date of receipt of their order to exercise their right of withdrawal, without having to provide any reason.

Returns are accepted only if the item is returned in perfect condition and in its original packaging.

Return shipping costs are the responsibility of the Customer, except in cases where the Seller is at fault (for example, if the product is damaged or incorrect).

No refund will be issued if the returned item is received damaged, incomplete, or after the legal 14-day period.

8. LIABILITY

Affiches d’Arts et de Cinéma cannot be held liable for non-performance of the contract in the event of force majeure, postal disruptions, strikes, or temporary unavailability of products.

9. INTELLECTUAL PROPERTY

All elements of the website — including texts, images, visuals, and logos — are the exclusive property of Affiches d’Arts et de Cinéma or its partners, and are protected under intellectual property law.

Any reproduction, modification, or unauthorized use is strictly prohibited.

10. PERSONAL DATA

Personal data collected when placing an order is necessary for order processing and fulfillment.

This information is never sold or shared with third parties.

The Customer has the right to access, correct, and delete their personal data at any time, in accordance with the General Data Protection Regulation (GDPR).

11. GOVERNING LAW AND JURISDICTION 

These Terms and Conditions are governed by French law.

In the event of a dispute, both parties will first seek an amicable resolution.

If no agreement is reached, the competent courts shall be those of the registered office of Affiches d’Arts et de Cinéma, located in Marseille, France.
